Motion for Summary Judgment

According to Colorado law, a party is entitled to summary judgment if they can show that "there is no genuine issue of material fact and that the moving party is entitled to a judgment as matter of law." In this case, the judge ruled that there are several issues of material fact and ruled against the Dunwodys, and in favor of the Elk Falls Property Owners Association.
